HIPAA and the dental IT relationship
An IT vendor's contract, access to patient information and actual safeguards matter more than a general compliance label. A practice should identify the parties' responsibilities, confirm the appropriate business associate agreement and maintain its own risk analysis and risk management process. These guides explain concepts; counsel should assess obligations for the specific practice.
Start with these guides
- HIPAA for dental offices, in plain English
Understand HIPAA concepts relevant to dental IT, including safeguards, business associates, risk analysis and the practice’s responsibilities.
- Business associate agreements for dental practices
Understand what a dental practice should discuss in a BAA, including permitted use, safeguards, reporting, subcontractors and exit provisions.
- Risk analysis vs risk management for dental IT
Distinguish a HIPAA risk analysis from risk management, vulnerability scans and compliance scores in a dental practice’s security program.
- What "HIPAA-compliant MSP" means (and does not)
Evaluate an MSP’s HIPAA claims through agreements, responsibilities and evidence rather than treating a marketing label as certification.
Does hiring an IT company transfer the practice's obligations?
No. Responsibilities depend on the organization's role and applicable requirements. Use the agreement and risk-management process to assign work, document safeguards and review evidence.
Is a security scan the same as risk analysis?
A scan is one input. A risk analysis must consider the organization's electronic protected health information, systems, threats and vulnerabilities. A numerical score alone does not provide that assessment.
How should time-sensitive rules be checked?
Read the current primary source, distinguish proposals from effective requirements and record the date of the check. Ask counsel to interpret notice duties, deadlines and exceptions for the actual facts.
